A "design box" WhatsApp group is created by the "Massey Gardens - Office" account, which I believe to be run by Sara Cooper-Leaning. She adds Becki, David Massey, Dawn, and various design and construction staff to the group.

Dawn apologises for the inconvenience as they can't make it as John Tallis is "on site" at one of their suppliers. Design reveal pushed to August 5th.

Dawn suddenly leaves the company and we are asked to only communicate with the current staff.
Sara Cooper-Leaning requests that we pay £33,732.00 as a deposit to secure building materials. I tell her that I don't want to pay a deposit on items that I'm not yet sure I'll get planning permission for and she amends the invoice to £15,732.00 for the other materials.

I receive an email from David Massey, informing me that he’s voluntarily put his company into liquidation. He says he is still hoping to somehow complete the garden work and wants to arrange a meeting.

Insolvency company issues state of affairs letter. They expect to be able to liquidate £17,250 but is charging £19,525 for their services. No chance of receiving deposit back via liquidation.

Online meeting for creditors is scheduled by insolvency company. I gather the aim is to approve the liquidator’s fees.

David fails to show up for the meeting with us.
We attempt to contact anyone from the WhatsApp group but the numbers are no longer in use.
We discover he lives with a his long term partner, Michelle Mook, who has businesses registered to the same address as Massey Garden Construction Ltd, and who is featured on Massey's own web site. Becki leaves a review of one of her businesses on her own Facebook page. Michelle is immediately in touch, claiming to have thrown David out of the house and has no idea of his whereabouts.
Michelle must have moaned to various other former Massey employees as John Tallis gets in touch to ask us to remove the review. We decline.

David messages the WhatsApp group to complain about the review and demands we apologize to Michelle. Clearly they were in touch. We decline his request to apologize. He seems to think that we are being unfair and that they are somehow the victims.

A process server is engaged by our solicitor to locate David Massey to serve him with a letter.

The process server has been unable to locate Massey, however I notice that David has registered a new company called David Massey Gardens Ltd, which is listed at Companies House.
His old company is, of course, also listed however, Companies House don't seem to realize that both David Massey officers on the 2 records are the same person.

Enquiry agents attend the new company address and in Pocklington and confirm that David Massey is either living at the address or has some connection to it. The letter is posted and he can reasonably be consider to have been served.

My solicitors send a second letter to Massey, giving him 7 more days and informing him of their intent to liase with the liquidator with a view to securing an assignment of the liquidator's claiming against him to us.
